Direct Mail Terms & Conditions

These Terms and Conditions are written to identify the responsibilities of the Customer, The Standard Press and Canada Post. They supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted. Use of The Standard Presses services constitutes acceptance of these Terms and Conditions. These terms should be reviewed prior to each mailing.
Pricing & Rates
Pricing of mail projects may change without notice due to increases in postage, changes in quantities or weight of the mail piece. Payment for all mail projects (printing, mail preparation and postage) are due prior to post office delivery. Payments must be received 1 day prior the delivery date unless stated otherwise by The Standard Press, failure to meet the payment deadline may result in delayed delivery.

Responsibilities
The Standard Press
The Standard Press is responsible for delivering printed goods to Canada Post on the date specified in writing by The Standard Press. The delivery may be delayed due to unforeseen circumstances in the manufacturing or mailing process. If no date is supplied or requested The Standard Press will determine a delivery date without notice to the customer.
The Standard Press can not guarantee the delivery date to the recipients. It is Canada Posts responsibility to deliver the printed goods within their delivery standard. See Canada Post delivery standards for delivery times.
The Standard Press exercises no control whatsoever over the content or information printed on customers mail projects. Mail lists, Mail Plans and mail related print files are held by the Standard Press and are kept strictly confidential. Mail lists and mail plans are never released to any other parties for any purpose.
Canada Post
Canada Post is responsible for all projects from the point of receiving the printed goods to delivery to the intended addresses. Canada Post is responsible for following all directions listed on the statement of mailing provided by The Standard Press. In a scenario where the Customer feels Canada Post has not fulfilled their service The Standard Press will facilitate the initial communication between the customer and Canada Post. The Standard Press will put the Customer in touch with Canada Post and provide both parities with all necessary information to perform an investigation if required.

Client
The client is responsible for reviewing and understanding the most updated mailing terms and conditions. The terms and conditions may change without notice and should be reviewed prior to each mailing. It is the responsibility of the client to have these terms available for whomever is administrating the mailing for the organization listed below. If the client has an agreement or contract with Canada Post it is the responsibility of the client to follow the terms of their agreement with Canada Post and relay all necessary information on to The Standard Press.

Neighbourhood Mail
The Standard Press has the right to classify mail projects as Consumer Choice and use Consumer Choice mail counts without notice. Homes who wish not to receive unaddressed mail may sign up to Canada Posts "do not mail list" and will be excluded from flyers, coupons, surveys, magazines, catalogue, note pads, provincial and federal frankings, material from candidates running in civic, provincial or federal elections and Municipal service notices, such as snow removal and garbage pickup information.

Personalized Mail
The Standard Press does not take any responsibility in costs incurred by mail projects being re-classified by Canada Post as lettermail, addressed admail machineable, addressed admail special handling or any form of publication mail. It is the responsibility of the client to ensure their peice meets the criteria of all forms of neighbourhood, personalized, publication and letter mail.
Limited Liability
Any liability of the Standard Press, including without limitation and any liability for damages caused or allegedly caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of or unauthorized access to, alteration of, or use of records, whether for breach of contract, negligence, or under any other cause of action, shall be strictly limited to the amount paid by or on behalf of the company to The Standard Press for the current mail project excluding postage.
Jurisdiction
Should any provision of this agreement be held to be illegal, invalid, or unenforceable by a court law, the legality, validity and enforceability of the remaining provisions of this agreement shall remain unaffected thereby unless otherwise stated. This agreement shall be governed by the laws of the province of Manitoba and Canada.
